Bicam, inaprubahan ang panukalang batas para gawing SSS member ang mga OFW

Inaprubahan na ng bicameral conference committee ng Kamara de Representantes at Senado ang panukalang batas na Social Security Act of 2018 para gawing miyembro ng Social Security System (SSS) ang mga overseas Filipino worker.

Dahil dito, kailangan na lang ratipikahan ng dalawang kapulungan ng Kongreso ang naturang panukalang batas, at kasunod nito ay pipirmahan naman ni Pangulong Rodrigo Duterte para ganap nang maipatupad.

Sa ilalim ng panukala, dapat maging miyembro ng SSS ang mga sea-and land-based OFWs na hindi pa umaabot sa 60 ang edad.

Mananatili namang boluntaryo kung nais maging miyembro ng SSS ang mga mga Pinoy na lumipat na ng paninirahan sa ibang bansa, permanent residents at naturalized citizens.

Nakasaad din sa panukala na ang mga sea-based OFWs at manning agencies, are "jointly and severally or solidarily liable with their principals with respect to the civil liabilities incurred for any violation of the SSS Law."

"Persons having direct control, management or direction of the manning agencies shall be held criminally liable for any act or omission penalized under the SSS Law," ayon pa sa probisyon.

Ikinukonsidera umanong "regularly employed persons " (with employer-employee share) ang mga sea-based OFW.

Inaatasan ng panukala ang SSS, ang Department of Foreign Affairs (DFA) at Department of Labor and Employment na tiyakan ang compulsory coverage ng mga OFW, "through bilateral social security and labor agreements and other measures for enforcement."

Dapat din umanong gumawa ng paraan ang DFA at DOLE upang makabuo ng kasunduan sa mga bansa kinaroroonan ng mga OFW para matiyak na makakapagbayad ng SSS contribution ang mga employer ng mga land-based OFW.

"[T]hese land-based OFWs shall no longer be considered in the same manner as self-employed persons in this Act," saad sa panukala.

"Instead, they shall be considered as compulsorily covered employees with employer and employee shares in contributions that shall be provided for in the bilateral labor agreements and their implementing administrative agreements," dagdag nito.

Sa sandaling matapos ang kontrata ng OFW, maaaring ipagpatuloy ng OFW ang kaniyang kontribusyon kung on a voluntary basis.-- FRJ, GMA News
