Order for arrest and hold departure on Trillanes


The Makati Regional Trial Court's Branch 150 has ordered the arrest of Senator Antonio Trillanes IV, whose seven-year-old amnesty was nullified by President Rodrigo Duterte late last month.

In an order issued Tuesday, September 25, Judge Elmo Alameda said he has found "factual and legal basis" for the issuance of Proclamation No. 572, the presidential directive that declared Trillanes' amnesty "void ab initio."

Alameda was "morally convinced" by the supposed legality of the proclamation on the basis of, among others, the government's presentation of a certification that shows "there is no copy of [Trillanes'] application for amnesty in the records."

"The Court's evaluation of the above Certification is that it confirms the claim of the prosecution that Senator Trillanes did not apply for amnesty," the order said.

The judge wrote that the lawmaker "failed to convince this Court that he indeed complied with the minimum requirement to personally fill-up and file the official amnesty application form..." and that he did not admit his guilt for offenses committed during the Oakwood Mutiny and the Manila Peninsula Siege.

Further agreeing with the Department of Justice, Alameda also said that the "resulting consequence" of the revocation of Trillanes' amnesty is that his dismissal of the rebellion case against the former Navy officer "becomes void ab initio."

Trillanes is expected to post bail, which is fixed at P200,000, for his temporary liberty. —NB, GMA News
