Tolentino: Car owner who recorded MMDA constable's extortion try may also be liable


Metropolitan Manila Development Authority (MMDA) Chairman Francis Tolentino on Sunday said that the car owner who recorded her "transaction" with an extorting traffic constable may also be held liable.
 
"Sa ganung entrapment ay may violation din po ang nag-entrap. Mayroon tayong Anti-Wiretapping Law. May provision sa batas na ang nag-o-offer ng batas ay liable din po iyan. Puwedeng maghabol ang na-entrap na enforcers," Tolentino said in an interview over radio dzBB.
 
In a video posted last September 23 in wheninmanila.com, private car owner Dianne Versoza recorded her conversation with an MMDA constable who apprehended her for alleged speeding on Commonwealth Avenue in Quezon City.
 
In the recording, the traffic enforcer repeatedly told Versoza that he will give her a traffic violation ticket. During the conversation, it was obvious that the traffic enforcer wanted the private car owner to offer him money.
 
In the end, the motorist and the enforcer agreed on a P210 payment.
 
"Wag 'mong itaas," the constable said in the recording, which was initially all audio, probably referring to the money held by Versoza.
 
When Versoza said that she only has P210, the constable told her: "Sige okay na 'yan. Iipit mo na lang sa lisensya mo. Puwede na 'yan."
 
The constable, however, was surprised when Versoza pulled out her hidden camera. At this point, the MMDA constable's face was shown in the video.
 
Versoza told the constable said that she is changing her mind and would instead pay the appropriate fine for the violation, which she denied in her post. She told the constable: "Mali eh."
 
Tolentino said that the MMDA constable has been relieved from his post in Commonwealth Avenue. —ALG, GMA News
