DOLE reminds employers of pay rules for Holy Week holidays


The Department of Labor and Employment on Thursday reminded employers to abide by pay rules for the Holy Week holidays on Maundy Thursday, Good Friday and Black Saturday. DOLE Secretary Rosalinda Baldoz said Maundy Thursday and Good Friday (March 28 and 29) are regular holidays while Black Saturday (March 30) is a special nonworking day. “I reiterate to our private sector employers to observe the pay rules and other core labor and occupational safety and health standards during these holidays in the interest of workers’ welfare and protection,” she said. Labor Advisory No. 6 issued in 2012 had contained guidelines on the pay rules for the holidays for 2013. Pay rules for March 28-29 Under the pay rules for Maundy Thursday and Good Friday:

- If the employee did not work, he/she shall get 100 percent of his/her salary for that day. The Cost of Living Allowance (COLA) is included in the computation of holiday pay. - If the employee worked, he/she shall get 200 percent of his/her regular salary for that day for the first eight hours. - If the employee worked more than eight hours, he/she shall get an additional 30 percent of his/her hourly rate on that day. - If the employee worked during a regular holiday that falls on his/her rest day, he/she shall get an additional 30 percent of his/her daily rate of 200 percent. - If the employee worked more than eight hours on a regular holiday that falls on his/her rest day, he/she shall get an additional 30 percent of his/her hourly rate on that day.
Under the pay rules for Black Saturday:
- If the employee did not work, the “no work, no pay” principle shall apply, except if there is a favorable company policy or collective bargaining agreement (CBA) granting payment on a special day. - If the employee worked, he/she shall be paid an additional 30 percent of his/her daily rate on the first eight hours of work. - If the employee worked more than eight hours, he/she shall get an additional 30 percent of his/her hourly rate on that day. - If the employee worked during a special day that also falls on his/her rest day, he/she will get an additional 50 percent of his/her daily rate on the first eight hours of work. - If the employee worked more than eight hours during a special day that falls on his/her rest day, he/she shall get an additional 30 percent of his/her hourly rate on that day.
