PNP-IAS fails to finish Kian delos Santos probe after Ombudsman takes over case


The Philippine National Police-Internal Affairs Office failed to finish its investigation on the death of Kian delos Santos after the Office of the Ombudsman took the case from it.

IAS Inspector General Alfegar Triambulo said he was supposed to give a recommendation on the administrative liability of Caloocan police officers involved in the case in October as he promised the Senate.

“Dapat ang Kian case tapos na noong October pa. Hindi ako tinigilan ng Ombudsman na kunin nila ‘yun kahit anong explanation ko na nauna kami at tapos na ang hearing,” Triambulo said over the phone.

He said the PNP-IAS had already received the position paper of the accused and he was supposed to draft his recommendation that he would submit to PNP chief Director General Ronald dela Rosa.

“October 20 tapos na ang position paper.

Pinangako ko kasi sa Senate na bago matapos ang October tapos na,” he said.

However, the Ombudsman insisted on taking over the case.

“Sinulatan ako nang sinulatan pinatawag pa ako doon. Pina-subpoenahan ako, wala akong magawa binigay ko na,” he lamented.

“Ang pinagtataka ko sila ay mag-imbestiga pa, ako gagawa na lang ng resolusyon kasi tapos na hearing at position paper. Wala pa nga sila, tapos na ako. Hindi ko alam kung ano ang interes nila. Bigyan lang daw sila kaya ibinigay ko ayaw ko ng away,” he added.

He said under the law, when a disciplinary authority has taken over the case, other agencies should respect it.

“Kapag nadocket ng isang diciplinary authority hindi na dapat makialam ang iba,” he said.

Triambulo said the Ombudsman told him that they would be the one to dispose the case.

“Kinuha nila lahat kasi sila daw ang mag-dispose. Pinagbigyan ko na sila.

Sinulatan ako una noong August 25,  sinagot ko ang kanilang fact finding. ‘Yung deputy ombudsman na mismo ang sumulat, nag subpoena, at nagpatawag sa akin sa office nila kaya binigay ko na,” he said.

He said they are mandated to cooperate with other investigating body but it should be limited to the criminal aspect as IAS is tasked to handle the administrative liability

“Sa aming rules sinasabi na makipag coordinate kami pero criminal lang sana sa kanila hindi ‘yung admin,” he said.

He believed their case against the cops involved in Kian’s death was strong with the admission of the cops that they were indeed the ones seen on the closed-circuit television.

Kian was killed in an Oplan Galugad operation in Caloocan in August. — MDM, GMA News
