Arraignment of Binays deferred anew

The Sandiganbayan on Friday deferred anew the arraignments of former Vice President Jejomar Binay and dismissed Makati City Mayor Jejomar Erwin "Junjun" Binay Jr. in their case over the alleged overpriced Makati City parking building.

This is the second and third postponement for Binay and Junjun, respectively. Only the elder Binay was present during the proceedings at the Third Division.

The new schedule of their arraignments has yet to be released as of posting time.

Both father-and-son have filed their respective quashal motions to dismiss the charges against them on the ground that the accusations against them does not constitute the crime alleged in the case information.

Binay was charged with four counts of graft, one count of malversation, and nine counts of falsification of public documents, while the younger Binay is charged with two counts of graft and six counts of falsification of public documents.

The case stemmed from a complaint filed by the Ombudsman accusing the respondents of implementing the project—divided in five phases, from 2007 to 2013, despite the absence of approved design standards, contract plans, agency cost estimates, detailed engineering and programs of work.

The Ombudsman initially filed a case against Junjun in February 2016 for the Phases IV and V of the project. It later filed a complaint for Phases I to III against Binay in July 2016, after the former vice president lost immunity from suit following the end of his term. — Joseph Tristan Roxas/RSJ, GMA News
