TRO sa ‘photobomber’ na Torre de Manila, inalis na ng SC


Tuloy na ang pagpapagawa sa kontrobersiyal na Torre De Manila condominium sa Maynila matapos alisin ng The Supreme Court (SC) ang ipinataw nitong temporary restraining order (TRO) nitong Martes.

Nabansagang pambansang ‘photobomber’ ang naturang proyekto dahil agaw-pansin ito sa likod ng monumento ni Jose Rizal sa Luneta.

Sa botong 9-6, ibinasura ng mga mahistrado ng SC ang inihaing petisyon ng Order of the Knights of Rizal dahil sa apat na dahilan, kabilang na ang kawalan ng hurisdiksyon para dinggin ang usapin na isinampa noong Setyembre 2014.

Deklara ng SC, walang batas na nagbabawal sa pagpapatayo ng naturang condominium building na pinamamahalaan ng DMCI Homes Inc.

"As a consequence of the judgment rendered today, the TRO (temporary restraining order) issued by the Court is lifted," saad ni SC spokesman Theodore Te.

Kabilang sa mga bumoto para ibasura ang petosyon ay sina Chief Justice Maria Lourdes Sereno, Senior Associate Justice Antonio Carpio, at Associate Justices Presbitero Velasco, Lucas Bersamin, Mariano del Castillo, Bienvenido Reyes, Estela Perlas-Bernabe, Marvic Leonen, at Noel Tijam.

Tumutol naman sa desisyon sina Associate Justices Teresita Leonardo-De Castro, Diosdado Peralta, Jose Mendoza, Francis Jardeleza, Benjamin Caguioa, at Samuel Martires.

Ikinatuwa ni DMCI Homes Inc. president Alfredo Austria ang desisyon ng SC at maipagpapatuloy na umano nila ang proyekto.

"We thank the honorable Supreme Court for its decision. The waiting game is over and we can now service to the needs of our customers," saad ni Austria sa inilabas na pahayag.

Iginagalang naman ng OKR ang desisyon at pinasalamatan ang publiko sa nakuhang suporta sa kanilang ipinaglaban na pamana ng bansa na itinuturing nilang "test case."

"The public support that was expressed in favor of our stand was an indication not only of the importance of the National Monument but also to the continued relevance and reverence our National Hero, Jose Rizal still enjoys. Beyond this, may we preserve the value of our national cultural treasures and remain to live the Rizal Way," anang grupo.

June 2015 nang magpalabas ng TRO sa konstruksyon ng Torre De Manila, na isang 49-storey building. -- FRJ, GMA News
