Caparas iginiit na inosente sa bintang na ‘di nagbayad ng P540M buwis

MANILA – Humarap na sa pagdinig ng Department of Justice nitong Huwebes ang kontrobersiyal na film at television director na si Carlo J. Caparas kaugnay sa kinakaharap nitong reklamo na tax evasion na umaabot sa P540 milyon. "Siguro merong pagkukulang o pagkakamali, pero wala akong kasalanan," pahayag ni Caparas sa mga mamamahayag matapos maghain ng kanyang counter-affidavit. Sa kanyang counter-affidavit, hiniling ni Caparas sa DOJ na ibasura ang mga sumusunod na reklamo ng tax evasion na inirekomenda ng Bureau of Internal Revenue: • 12 counts of alleged failure to file quarterly income tax returns; • Four counts of alleged failure to file annual income tax returns; at • 48 counts of alleged failure to file value added tax returns for the taxable years of 2006, 2007, 2008, and 2009 in violation of Section 255 of the National Internal Revenue Code. "I respectfully pray that the instant criminal complaint be dismissed for lack of factual and legal basis and more so for having violated my constitutional, statutory rights of due process of law," nakasaad sa affidavit ni Caparas.

Inaatasan ng BIR si Caparas na nagbayad ng P540 milyon halaga ng mga unpaid taxes, surcharges, at penalties dahil sa hindi pagsusumite ng kanyang tax returns mula 2006 hanggang 2009. Lumitaw din sa imbestigasyon ng BIR na tumanggap si Caparas ng P850 milyon mula sa Philippine Charity Sweepstakes Office bilang kabayaran sa kanyang serbisyon bilang direktor at paggawa ng mga programa ng ahensiya sa telebisyon. Ang naturang kinita ni Caparas sa PCSO ay hindi rin umano idineklara ng direktor at hindi rin nagbayad ng buwis para dito. Noong nakaraang linggo ay hindi nakapagsumite si Caparas ng kanyang affidavit sa DOJ dahil kinukompleto pa umano nito ang mga dokumento, ayon sa kanyang misis na si Donna Villa. "Under the subject PCSO contracts, it is specifically provided that 'all payments shall be net of taxes.' Clearly by virtue of the said stipulation, the PCSO expressly undertook and stipulated to shoulder the responsibility of taking care with the payment of all taxes arising under the contracts and all other legal obligations connected therewith...," paliwanag nito. "Otherwise stated, by undertaking to pay my compensation net of all taxes, the PCSO already assumed the obligation of deducting and withholding from my compensation the taxes due therefrom, and of remitting the same to BIR," idinagdag ni Caparas. - GMANews.TV
