Senador: Psych test para sa mga nominado sa CJ posisyon, hindi unconstitutional

Ipinagtanggol ni Senator Francis Pangilinan ang patakaran ng Judicial and Bar Council na isailalim sa pyschological test ang mga nominado para sa Chief Justice position. “The mandate of the JBC is to ensure that those shortlisted are qualified and meet the requirements laid down by the Constitution. I disagree with those who say that these additional requirements are unconstitutional," ani Pangilinan, dating miyembro ng JBC, sa isang pahayag na inilabas nitong Miyerkules. Nakasaad sa JBC-009 Rule 6 Section 2: “The applicant shall submit to psychological and/or psychiatric tests to be conducted by the Supreme Court Medical Clinic or by a psychologist and/or psychiatrist duly accredited by the Council.” Tinutulan ni Atty. Romulo Macintal noong Martes ang patakaran sapagkat paglabag umano ito sa Saligang Batas ng Pilipinas, tulad ng patakarang pagsusumite ng waiver ng mga bank deposit. Ayon naman kay Pangilinan, may ibang screening requirements umano tulad ng public interviews ang hindi nakasaad sa Konstitusyon ngunit hindi nangunguhulugang unconstitutional ang mga ito. “How can the JBC fulfill its duty to ensure that only the qualified are nominated if it cannot even interview a nominee because the Constitution does not say that interviews are required?” aniya.   “Clearly, this is not the intent of the framers of our Constitution,” dagdag pa niya.
