JBC, pumayag na palitan si De Lima mula sa CJ selection panel 

Papayagan na ng Judicial and Bar Council (JBC) si Pangulong Benigno Aquino III na palitan si Justice Secretary Leila de Lima mula sa panel na nakatalagang maghirang ng bagong punong mahistrado sa Korte Suprema, inihayag ni Senator Francis Escudero nitong Lunes.

 

"Consensus na lamang. Meron kasing representative ang Supreme Court kaya dapat meron din ang Chief Executive," ani Escudero.

 

"Pinapaboran ng Konstitusyon ang mas malawak na representasyon," dagdag niya.

 

Sa isang Huyo 13 na liham na ipinadala sa JBC, ayon kay Executive Secretary Paquito Ochoa Jr., nais ni Aquino na payagan siya ng council na maghanap ng papalit kay De Lima bilang kanyang kinatawan sa pagpili ng bagong CJ.

 

"The secretary of Justice is the sole alter ego and representative of the President in the council and her absence would do away with the equal representation of the executive, legislative, and the judiciary in the council intended by the Constitution," aniya.

 

Binuo ang JBC sa ilalim ng 1987 Konstitusyon na nakatalagang pumili ng tatlong nominado para sa mga bakanteng posisyon sa mga korte. Ang Pangulo lamang ang maaaring maghirang ng mga judge at justice mula sa short list ng mga nominadong isusumite ng JBC.

 

Kabilang sa JBC ang chief justice ng Korte Suprema bilang ex officio chair, kasama ang secretary of justice, at ang mga chair ng House at Senate justice committees bilang mga ex officio na miyembro. Nanggaling naman ang apat na regular na miyembro mula sa Integrated Bar of the Philippines, academe, pribadong sektor, at retired na miyembro ng Korte Suprema.

 

Sa kabila nito, nag-inhibit si De Lima mula sa selection process matapos niyang maging nominado para sa posisyon.

 

Sa isang press briefing naman sa Malacañag nitong Lunes, inihayag ni presidential spokesperson Edwin Lacierda na sa kabila ng paghirang ng Pangulo sa iba pang mga miyembro ng JBC, hindi sila alter egos ng Pangulo at hindi kumakatawan sa executive branch.

 

"The executive branch is assured of representation only through the secretary of Justice. Thus, where, as in this instance, the secretary of Justice is herself one of the nominees and therefore has to inhibit herself, the executive branch will not have a representative in the council during the deliberations for the selection of the nominees for chief justice," kanyang inihayag sa isang liham.

 

Ayon sa kanya, hindi pa sila nakapipili ng maaaring pumalit sa bakanteng poste ng JBC.

 

"There are no names yet that have been mentioned in the letter," aniya.

 

Ayon kay Escudero, maaaring maghirang si Aquino ng kahit sino mula sa executive branch na ang posisyon ay hindi mas mababa sa undersecretary.

 

"It can be the Executive Secretary himself if he wants to attend," aniya.
