Mas matagal na liquor ban dahil sa eleksyon, dapat ba?

Sa botong 4-1, pinalawig ng Commission on Elections (Comelec) ang liquor sa loob ng limang araw mula sa dating dalawang araw bago ang halalan. “Our feeling is that it is the heat of the end part of the campaign, very close to the election. We want to make sure that it will be quiet and peaceful at least five days before the elections,” paliwanag ni Comelec chair Sixto Brillantes nitong Miyerkules. “That would lessen the tension kasi maraming nag-iinuman lalo na 'pag Saturday, miting de avance,” dagdag niya, sabay paalala na "non-campaign period" ang Linggo, isang araw bago ang halalan sa Mayo 13 (Lunes). Ayon sa Comelec en banc, ipatutupad ang liquor ban mula Mayo 9, 2013 (Huwebes) hanggang Mayo 13, 2013.  Bumoto pabor sa pagpapalawig sina Brillantes, Commissioners Lucenito Tagle, Elias Yusoph at Grace Padaca. Sumalungat naman si Commissioner Christian Robert Lim dahil sa paniwala nito na hindi maaaring baguhin ng komisyon ang batas na nagtatakda ng panahon ng liquor ban. Nakasaad sa Section 261 (dd) (1) ng Omnibus Election Code na ipinagbabawal sa sinuman ang, “to sells, furnishes, offers, buys, serves or takes intoxicating liquor on the days fixed by law for the registration of voters in the polling place, or on the day before the election or on election day.” Dagdag nito, “hotels and other establishments duly certified by the Ministry of Tourism as tourist oriented and habitually in the business of catering to foreign tourists may be exempted for justifiable reasons upon prior authority of the Commission: Provided, further, That foreign tourists taking intoxicating liquor in said authorized hotels or establishments are exempted from the provisions of this subparagraph.” Hiling ng MMDA Nabuo umano ang desisyon ng Comelec matapos hilingin ni Metropolitan Manila Development Authority (MMDA) chairman Francisco Tolentino na i-extend ang liquor ban ng 60 araw. Ayon kay Brillantes, hindi niya maaaring pagbigyan ang kahilingan ni Tolentino dahil masyado na itong matagal at inaasahang magkakaroon ng reaksiyon sa mga gumagawa ng alak. Aminado naman ang opisyal na wala silang kinonsulta nang gawin ang kanilang desisyon na palawigin ng limang araw ang ban sa pag-inom ng alak. Gayunman, maaari naman umanong kuwestiyunin sa Korte Suprema ang naging desisyon ng Comelec, ayon pa kay Brillantes.
