Ibinasura ng Makati Prosecutor's Office ang reklamong pagnanakaw (qualified theft) na inihain ng aktres na si Kris Aquino laban sa kaniyang dating kasosyo sa negosyo na si Nicko Falcis.
Ayon sa resolusyon ng Makati Prosecutor's Office, wala umanong sapat na ebidensiya ang kampo ni Kris upang suportahan ang mga akusasyon nila laban kay Falcis.
"At the onset, it is important to note that no evidence was presented with regard to any agreement between Aquino and Falcis as regards the use of the subject credit card," saad sa resolusyon.
"Accordingly, the basis rule is that mere allegation is not evidence and is not equivalent to proof," dagdag nito.
Matatandaang inakusahan ni Aquino si Falcis ng pagnanakaw sa pamamagitan ng paggamit ng credit card ng kaniyang kumpanya nang wala umano siyang pahintulot.
Sinabi noon ni Aquino na nagbigay ng P400,000 check si Falcis na tanda umano ng pag-amin na inabuso nito ang pondo ng kaniyang kumpanya.
Pero ipinunto sa resolusyon na nakapangalan kay Falcis ang nasabing credit card.
"Given the foregoing, Falcis' use of the KCAP card for his personal expenditures would not make him liable for theft. He is only liable to BDO for the card transactions that had made using the card," sabi sa resolusyon.
Balak namang maghain ng motion for reconsideration ang kampo ng aktres. -- FRJ, GMA News
