Pasig prosecutor dismisses Kris Aquino’s complaint vs. Nicko Falcis


A Pasig City prosecutor dismissed the charges of qualified theft and violation of the Access Device Law filed by actress Kris Aquino against former business associate Nicko Falcis.

In a resolution dated February 15 obtained by GMA News on Tuesday, Senior Asst. City Prosecutor Aileen C. Sabare dismissed Aquino's complaint for insufficiency of evidence.

The complaint filed for violation of Republic 8484 or the Access Devices Regulation Act of 1998, on the other hand, also did not stand because the credit card was "voluntarily issued" by Aquino to Falcis.

Aquino had claimed that Falcis had amassed unauthorized charges amounting to P129,680 under Pasig City's jurisdiction using the credit card that was issued for her production company's expenses.

The purchases were made in Lucendi Pasig and Toby Estates Pasig. The specifics, however, of the transactions were not included in the submitted evidence.

"It appears that the credit card used by respondent was neither stolen, lost, expired, revoked, cancelled, suspended or obtained with intent to defraud," the decision read.

"The credit card was voluntarily issued to respondent under his name," it added.

"Thus, when the respondent used the credit card for purchases at Lucendi and Toby's Estate in Pasig City, the credit card cannot be considered as unauthorized within the tenets cited by law," the decision read.

GMA News Online reached out to Aquino's camp for comment but has yet to receive a reply as of posting time.

A Makati prosecutor has also junked a separate complaint by Aquino against Falcis.

Aquino filed 44 counts of qualified theft against Falcis before city prosecutors in Mandaluyong, San Juan, Taguig, Pasig, Makati, Manila and Quezon City for allegedly spending P1.2 million from Aquino's business fund for his personal expenses.
