IAS chief confident they have airtight case vs. Caloocan cops


Internal Affairs Service Inspector General Alfegar Triambulo expressed confidence Friday that they have an airtight administrative case against the police officers involved in the death of Kian Loyd delos Santos despite their denial.

“Ang masasabi ko lang very airtight naman kahit wala po (‘yung pag-amin nila), ‘yun ang aming findings sa ngayon,” Triambulo told reporters.

“Meron na po kaming malakas na mga ebidensya na para mafile-an sila ng asunto,” he added.

Triambulo earlier said that two of the three Caloocan cops admitted to an IAS investigator that they were the ones seen on closed-circuit television footage dragging Delos Santos on the day he was killed

But during the Senate hearing Thursday, Police Officer 1 Jerwin Cruz said he and Police Officer 1 Jeremias Pereda were indeed the one caught on CCTV but it was an asset and not Delos Santos they were holding

But Triambulo maintained that lapses and violations committed by the police in their conduct of operation were enough basis to file a case against them.

“Kahit wala po yung CCTV, admission, kami ay naniwala na matibay yung aming kaso dahil nakita n’yo naman po sa mga sinasabi nila sa hearing ng Senate na wala talaga silang basis na i-operate si Kian. Therefore, dahil may nakakitang dinampot nga si Kian doon sa harapan ng sari-sari store so wala po silang legal basis para arestuhin ang tao na ‘yun,” he said.

“Pwede mo lang arestuhin na walang dalang warrant kung ikaw ay gumawa ng kasalanan in the presence ng otoridad,” he added.

Triambulo said the police should have immediately brought Delos Santos to their mobile and to the precinct where charges will be prepared against him.

“Bakit po dinala nila doon ang kanilang inaaresto assuming na legal (ang pag-aresto) at doon natagpuan na patay. Lumalabas na may paglabag nga sila na sari-saring violation, legal at police operational procedure,” he said.

Triambulo said they somehow expected the denial as the admission was not reduced into writing and the police do not have a lawyer when they made the statement to an IAS investigator.

“Expected po ‘yun syempre. Alam din kasi nila na hindi binding ‘yun kasi yung imbestigador hindi nya in-accord yung right nung mga tao na ‘yun, ‘yung sinasabi na with the assistance of counsel para yung admission nila maging admissable sa court bilang ebidensya,” he said.

He added that even with a counsel, a person can still retract his statement.

“Kahit na nag-admit with assistance of counsel talagang anytime pwedeng bawiin,” he said. — RSJ, GMA News
