SC directs lawyers not to discuss anti-terror law case in media

The Supreme Court (SC) on Tuesday instructed lawyers involved in the legal challenge against the Anti-Terrorism Act of 2020 to refrain from discussing the merits of the petitions in media.

Chief Justice Diosdado Peralta issued the appeal as he noted that several lawyers were interviewed on television about the matter.

“We would like to ask the lawyers to please refrain from being interviewed while these cases are pending resolution. You know the effect when one goes to the media and discusses his positions, it might affect the outcome of these cases,” he said before concluding the second day of oral arguments.

The sub judice rule restricts comments and disclosures on judicial proceedings to avoid prejudging the issue, influencing the court, or obstructing the administration of justice.

Those who violate the rule may be held liable for indirect contempt under the Rules of Court.

“We do not like that we will use our coercive power in disciplining lawyers,” Peralta said.

A total of 37 petitions were filed assailing the anti-terrorism law, making it one of the most challenged Philippine laws.

Retired SC justices Antonio Carpio and Conchita Carpio Morales were among its critics, as well as lawmakers, activists, teachers, students, artists, and journalists, who argued that it violated basic rights and legitimized supposed state attacks against government critics.  — DVM, GMA News
