Ex-Butuan City treasurer faces raps for late GSIS remittance


Ombudsman Conchita Carpio-Morales ordered the filing of charges against former Butuan City Treasurer Adulfo Llagas for his alleged failure to remit the GSIS contributions of employees of the Butuan Medical Center (BMC) on time.
 
In a statement issued on Monday, the Office of the Ombudsman said that upon thorough investigation, it was found out that Llagas failed to remit the GSIS payments of BMC employees for the period covering November 2007 to December 2008.
 
“During investigation, it was established that Llagas failed to deduct the GSIS monthly contributions of BMC employees which resulted into [sic] the belated remittance to the GSIS,” the Ombudsman said.
 
Charges of violation of Section 52 (d) of Republic Act 8291, or the Government Service Insurance System Act, have been ordered filed against him.
 
Under Section 52 (d) of RA 8291, the failure of concerned government official to remit the GSIS premium contributions of employees, shall upon conviction, suffer the penalties of minimum of six months and one day to maximum of six years of imprisonment and a fine of not less than P3,000 but not more than P6,000.
 
The convicted officials shall also suffer “absolute perpetual disqualification from holding public office and from practicing any profession or calling licensed by the government”.
 
Under Section 6 of RA 8291, “each employer shall remit directly to the GSIS the employees' and employers' contributions within the first ten days of the calendar month following the month to which the contributions apply.” — Elizabeth Marcelo/JDS, GMA News
