Cyber unjust vexation raps recommended vs Topacio over insults against Comelec exec Guanzon


The Iloilo Prosecutor's Office has recommended the filing of unjust vexation charges against lawyer Ferdinand Topacio for allegedly insulting election commissioner Rowena Guanzon last year.

In a tweet on Tuesday, Guanzon shared an excerpt of the prosecutor's resolution which recommends the filing of information against Topacio for "cyber unjust vexation under Article 287, paragraph 2 of the Revised Penal Code of the Philippines as amended by Section 73 of R.A. 1095 and in relation to Section 6 of R.A. 10175 (Cybercrime Prevention Act of 2012)."

"Guess who will get a warrant of arrest soon," Guanzon wrote in her tweet.

It can be recalled that Guanzon filed a complaint for unjust vexation against Topacio for "mocking" her late mother who died of Alzheimer's disease at 95.

"F Topacio mocked me for having the same disease and vexed and annoyed me to no end through Twitter and FB (Facebook). I have filed a complaint against him for Unjust Vexation in Bacolod," the poll officer said in a tweet in August 2020.

The resolution, dated May 12, 2021, recommended that only one count of unjust vexation can be charged against Topacio for a "single criminal intent to vex and annoy the complainant."

Meanwhile, Topacio said he has yet to receive the resolution and an arrest warrant, adding that some people have alerted him about it.

"I am used to this, this is an occupational hazard of someone who fights the rights of other people," Topacio said in a phone interview with GMA News Online, reacting to the recent tweet of Guanzon.—AOL, GMA News
