SC to Palace: Explain why no habeas corpus should be issued vs. Duterte arrest
By GMA Integrated NewsThe Supreme Court has ordered the respondent government officials in the petitions for habeas corpus seeking the release of former President Rodrigo Duterte to comment in 24 hours on why the writ should not be issued.
According to the SC spokesperson, the en banc on Thursday also resolved to consolidate the petitions for habeas corpus separately filed by Duterte's children Davao City Representative Paolo "Pulong" Duterte, Davao City Mayor Sebastian "Baste" Duterte, and Veronica "Kitty" Duterte.

The respondents in the petitions include Executive Secretary Lucas Bersamin, Justice Secretary Jesus Crispin Remulla, Interior Secretary Juanito Victor Remulla, PNP chief Police General Rommel Marbil, and Criminal Investigation and Detection Group chief Police Major General Nicolas Torre III.
The Duterte siblings filed the petitions after the elder Duterte was arrested last Tuesday on the basis of a warrant issued by the International Criminal Court, and brought to The Hague.
"So ang mga grounds po natin para sa petition na ito ay unang-una hindi pwede maging batayan ng pag aresto at pag detena ng dating Pangulong Duterte ang ICC warrant of arrest dahil walang jurisdiction ang ICC sa ating bansa,” said Kitty's lawyer Salvador Paolo Panelo Jr. in an ambush interview.
(The grounds for our petition, first of all, is that the arrest warrant cannot be used as a basis for the arrest and detention of former President Duterte because the ICC has no jurisdiction in the country.)
Baste also argued that the ICC has no jurisdiction over the Philippines and that the former president was deprived of medical care while he was in police custody.''The unlawful execution of an ICC warrant, despite the Philippines' formal withdrawal from the Rome Statute, underscores a direct attack on national sovereignty and an illegal deprivation of liberty,'' Baste's petition said.
In his petition, Pulong asked the SC to issue a writ of habeas corpus and for his father to be discharged from confinement and detention.
He also asked the court to issue a temporary restraining order or a writ of preliminary injunction to direct the government to desist from cooperating with the International Criminal Court (ICC) as well as the International Criminal Police Organization (Interpol). –NB, GMA Integrated News
