The Supreme Court has not issued a temporary restraining order in the petition of former President Rodrigo Duterte and Senator Ronald Dela Rosa that seeks to prohibit government agencies from cooperating with the International Criminal Court (ICC) and its investigation into Duterte’s war on drugs.
In a statement released on Wednesday, March 12, 2025, the court said it received the petition for the issuance of TRO and writ of preliminary injunction around 4:27 p.m. on Tuesday, March 11, 2025.
It said the petitioners failed to establish a clear and unmistakable right for the immediate issuance of a TRO.
“After a virtual deliberation on the 94-page petition, the SC found that the petitioners failed to establish a clear and unmistakable right for the immediate issuance of TRO,” the statement said.
However, it directed the respondents to comment on the petition within 10 days from notice.
SC also acknowledged receipt of two petitions for the writ of habeas corpus for the former president filed separately by his children, Davao City Mayor Sebastian Duterte and Veronica Duterte.
“These petitions seek the issuance of a writ of habeas corpus commanding respondents Executive Secretary Bersamin et.al. to appear before the SC, produce the body of former President Duterte, and explain his imprisonment,” the statement added.
In a related development, Duterte’s children, Veronica Duterte and Davao City Mayor Sebastian Duterte, have also sought the help of SC in bringing Duterte back to the Philippines.
Duterte was flown to The Hague, Netherlands evening on March 11 just hours after he was arrested in the Philippines for alleged crimes against humanity during his administration's anti-illegal drugs campaign.
The plane carrying Duterte arrived in Dubai for a layover on Wednesday morning.
