THE HAGUE, Netherlands – Former Bayan Muna representative and human rights lawyer Neri Colmenares said the prosecution laid down a “very methodical” and “very strong” case on the second day of the confirmation of charges hearing before the International Criminal Court  (ICC) against former President Rodrigo Duterte.

According to Oscar Oida’s report in “24 Oras” on Tuesday, three police officers were found guilty of murder in the death of then 17-year-old Kian delos Santos. They were sentenced to reclusion perpetua, or up to four years of imprisonment, aside from paying damages to Kian’s family.

The International Criminal Court (ICC) Prosecution must be able to establish criminal intent in the crimes against humanity case of former President Rodrigo Duterte in relation to his administration's bloody drug war, an international law expert said on Tuesday. 

“They need to establish, number one, yung pinaka importante kasi is yung criminal intent, yung sinasabi natin sa law na mens rea—yung criminal mind na dapat at the time that you participated in the commission of these acts, either indirectly or directly as an indirect perpetrator, dapat may criminal intent ka,” Ralph Sarmiento said in an interview with GMA Integrated News as the confirmation of charges hearing was underway at the ICC in The Hague.

EJK victims’ kin hopeful as ICC confirmation hearings on Duterte advance

Families of victims of the drug war expressed hope that former President Rodrigo Duterte will be brought to trial at the International Criminal Court (ICC), citing sufficient evidence against him.

According to Marisol Abdurahman’s report on "24 Oras" Tuesday, some relatives of the victims traveled to the Netherlands to closely monitor developments in the proceedings.

International Criminal Court (ICC) prosecutor Robynne Croft on Tuesday described the roles of former President Rodrigo Duterte’s co-perpetrators in his war on illegal drugs, beginning with Senator Ronald “Bato” Dela Rosa’s order to self-confessed drug users and pushers to kill drug lords and set their houses on fire.

On the second day of Duterte’s confirmation of charges hearing, Croft said Dela Rosa, who was then the chief of the Philippine National Police (PNP), made the speech in August 2016. 

The prosecutor also related the roles of former police officials Vicente Danao and Isidro Lapeña, and lawyer and former Justice Secretary Vitaliano Aguirre II during the hearings held before the ICC Pre-Trial Chamber I.

Reso pushing for PH court remedies before ICC action reaches Senate floor

The Senate on Tuesday began tackling a resolution seeking to express the sense of the chamber to allow Filipinos accused of crimes abroad to first avail legal remedies from Philippine courts before they are surrendered to international tribunals.

During the plenary session, Senator Rodante Marcoleta sponsored proposed Senate Resolution No. 307.

He stressed that it is not solely about former President Rodrigo Duterte and it is not limited to matters involving the International Criminal Court (ICC). 

Duterte requests to skip hearing on his detention on February 27

Former president Rodrigo Duterte has requested to waive his rights to attend the International Criminal Court’s (ICC) hearings on his pre-trial detention on Friday, Feb. 27, 2026.

“The Defence for Rodrigo Roa Duterte hereby notifies the Pre-Trial Chamber of Mr. Duterte’s request to waive his right to attend the annual hearing under Rule 118(3) of the Rules of Procedure and Evidence. The hearing is presently scheduled for 27 February 2026 at 14:00,” the document read.

It was signed by Duterte’s legal counsel Nicholas Kaufman on Monday.
