Bohol Governor Erico Aristotle Aumentado is set to file a motion for reconsideration to the Ombudsman's decision on the controversial Captain’s Peak Garden and Resort case.
In a statement posted on Bohol Provincial Government's official social media page, Aumentado said:
“Under the administrative domain, I, along with some mayors, were only given a reprimand. Under the criminal aspect, however, the Office of the Ombudsman has ordered the filing of a criminal case in violation of Section 3(e) and Section 3(j) of Republic Act 3019, otherwise known as the Anti-Graft and Corrupt Practices Act, against me, two former governors, and other respondents."
He added that his camp is preparing their response to the resolution and will be filing a motion for reconsideration before the Office of the Ombudsman.
“I maintain that I did not violate any law insofar as this case is concerned. It can be recalled that when the Captain’s Peak issue first came to light in 2023, I immediately directed an investigation,” Aumentado added.
He looks forward to a reconsideration on the Ombudsman resolution.
“I am hopeful the Ombudsman will reconsider its resolution and that I, along with others who are not involved in the case, will be cleared of any wrongdoing,” Aumentado further stated.
To recall, in May 2024, Captain's Peak Garden and Resort in the Municipality of Sagbayan, drew flak because of its construction amid a geological monument.
The resort was built inside a protected area, and a global geopark, recognized by the United Nations Educational, Scientific and Cultural Organization (UNESCO).
Following the incident, at least 69 elected officials and officials of various government agencies were placed under preventive suspension.
Social media pages of Captain's Peak Garden and Resort showed the facility—complete with swimming pools, slides, cabanas, and a signature heart-shaped landmark—surrounded by the unique land formations of the Chocolate Hills.
Based on its introduction on Facebook, the Captain's Peak Garden and Resort is a "tourist destination located in the midst of the toweringthe [sic] chocolate hills in the area. It is located at Libertad Norte, Sagbayan, Bohol. You can see the closer look of the scenic chocolate hills."
When sought for comment, the Department of Environment and Natural Resources disclosed that it issued a Temporary Closure Order against the controversial resort on September 6, 2023, and a Notice of Violation to the project proponent on January 22, 2024 for operating without an Environmental Compliance Certificate, or ECC.
