The local government of Samal Island has expressed concern that the operation of the Davao Light and Power and Company (Davao Light) as the new power distributor in the island may be delayed due to the supposed persistent resistance of the Northern Davao Electric Cooperative (NORDECO) during the transition period.

Mayor Toto Reyes said that if NORDECO continues to be uncooperative, the transition of electric services could face delays, which would affect residents and business establishments.

“Ang akong gikabalak-an, madugay syempre, magtukod pa man sila’g poste kung mag (coordinate) sila sa transition maghinay-hinay na lang sila’g connect sa mga poste tanggalon ang mga daot pulihan og sariling poste sa Davao,” Reyes said.

Under Republic Act 12144, Davao Light’s franchise areas were expanded to Davao de Oro and Davao del Norte, including Samal Island.

However, NORDECO claimed that it remains the legitimate electric distribution utility for these areas, pending results of its appeal before the Supreme Court involving their petition against RA 12144.

Davao Light explained earlier that while it respects the opinion of NORDECO, its actions are in accordance with the law, including the mandated two-year transition period.

“I understand that there are cases have been filed in the supreme court but you know without any ruling or any actions from the court the law is regular meaning it’s in effect and we are just complying with the law,” Davao Light Head, Engr. Enriczar Tia, said.

Reyes said he will push harder for Davao Light to begin operations as the tourism sector, consumers, and business owners have been affected by what he described as NORDECO’s poor service.

“Ingon ko pasagdi na sila nga di sila motabang sa transition ang importante makasugod mo makahinay-hinay mo og tukod og poste hangtod nga mawala na sila kay sigurado ko nga ang taga Samal Davao Light gyud ang pillion,” Reyes added.

A committee of the Sangguniang Panlalawigan of Davao del Norte has earlier approved a resolution that seeks to oppose NORDECO’s franchise renewal to allow speedy transition.

NORDECO objected to the resolution, claiming that it violates constitutional provisions against monopolies in public utilities.

Governor Edwin Jubahib said that the Energy Regulatory Commission (ERC) is set to issue a Certificate of Public Convenience and Necessity (CPCN) before the end of 2025, which would allow the Davao Light to construct and provide power connections.
