A van attempting to overtake a tricycle caused a collision and the death of a man in Barangay Pook-ni-Banal, San Pascual, Batangas early afternoon on November 15, 2023.

The fatality was identified as Danilo Cabagyo, 57.

Cabagyo, who did not inform his family about his departure, was reportedly on his way home when he figured in the accident. 

Gloria Panopio, the victim's sister, said, "Danny, kung saan ka man naroroon ay mahal na mahal ka namin ng iyong mga kapatid. Pumunta ka na sa iyong pupuntahan ng maayos."

Based on investigation, the collision happened at the stretch of the road in Barangay Pook-ni-Banal. The van miscalculated its overtaking maneuver, leading to the tragic incident.

PMaj. Ernie Delos Santos, Acting Chief of Police in San Pascual, explained, "Ito po ay same direction pababa ng Padre Castillo, ngayon itong van, nabangga niya sa likod itong tricycle na kung saan tumalsik 'yung angkas nitong driver ng tricycle. Hindi naman kabilisan, ma'am, itong van sa takbo, na-miscalculate niya 'yung pag-overtake doon sa tricycle nasabitan niya 'yung gilid ng tricycle. 'Yun ang naging dahilan." 

The victim was rushed to the hospital but succumbed to his injuries later that night. The tricycle driver, who also sustained injuries, has been discharged from the hospital. As of this writing, the van driver, Venz Ulpina, is temporarily in police custody.

He said, "O-overtake-an ko po talaga para malampasan eh pag-overtake ko po bigla na lang siyang pumasok doon sa kaliwa kaya namreno ako nag-full stop, inabot pa rin po. Humihingi rin po ako ng pasensya sa hindi ko naman po kagustuhan ang nagawa ko. Delivery (boy) lang naman po ako, kailangan ko lang din po mag-hanapbuhay."

While the family believes it was an accident, they expressed their intention to pursue a case against the van driver. 

Delos Santos advised, “Tingin ko'y medyo madulas at maulan kahapon, so sa ganoong mga panahon mag-ingat po tayo lalo na't hindi po natin kabisado 'yung daan na dinadaanan natin. Ang daan na 'yun ay medyo hindi kalakihan so miscalculate ang nangyari sa driver ng van kaya nabangga niya ang tricycle."
