Senator-Judge Juan Miguel Zubiri on Wednesday brought to the floor a request by his colleagues to slightly move the time of the impeachment trial due to supposed concerns about traffic.

Zubiri said that “most” of the senator-judges had requested to adjust the schedule of the start of the trial from 10 a.m. to 10:30 a.m.

With this, he said the trial may end by 3:30 p.m. instead of 3 p.m., and the session may begin at 4 p.m.

“Because like the minority leader who comes from Bicutan, inaabutan po siya ng traffic ‘pag maaga. Ganoon din ang haba ng biyahe niya,” Zubiri said, referring to Senator-Judge Alan Peter Cayetano.

“So, baka pwede naman ma-adjust natin ng 10:30 ng umaga and then 3:30 ng hapon tayo matapos, at 4 o’clock tayo mag-session kasi anyway, ililipat lang naman natin ang mga lamesa, madali lang naman ‘yan gawin. We don’t need one hour,” he added.

A former manager of the Land Bank of the Philippines (LandBank) branch serving the Department of Education (DepEd) testified Wednesday that three checks worth P37.5 million each were encashed by the agency’s special disbursing officer (SDO) in 2023 despite the absence of documents proving his designation.

Nenita Camposano made the statement while testifying as a prosecution witness on the 10th day of Vice President Sara Duterte’s impeachment trial, as senator-judges sought clarification on her earlier testimony that she personally oversaw the encashment of the checks and the turnover of the cash.

Senator-Judge Raffy Tulfo asked Camposano whether DepEd SDO Edward Fajarda had submitted any document to the LandBank DepEd branch proving that he was the officially designated to encash the checks.

“Wala po (There was none),” Camposano answered.

Several women’s rights advocates, academics, and feminists on Wednesday filed an ethics complaint against Senator Pia Cayetano over a social media post that allegedly featured a spliced video of Akbayan party-list Rep. Chel Diokno in the impeachment trial.

The complainants asked the Senate Ethics Committee to investigate and impose appropriate disciplinary sanctions against Cayetano for allegedly posting the misleading video while serving as a senator-judge in the ongoing impeachment trial of Vice President Sara Duterte.

“Naniniwala kami na dapat imbestigahan ang ginawang pag-post ni Senator Pia ng spliced video during an impeachment trial process," Juanna Caumeran of EveryWoman told reporters.

"Naniniwala kami na ito ay hindi magandang conduct, hindi tamang conduct ng isang senador, lalong-lalo na ng isang senator-judge sa isang ongoing impeachment trial,” she added.

The testimony of two former LandBank officials who described the withdrawals of hundreds of millions in cash by personnel under the Office of the Vice President and the Department of Education under Vice President Sara Duterte as "unusual" is just an appetizer of the evidence that the prosecution have against the Vice President, House prosecutor Lorenz Defensor said.

Defensor was referring to the statements of prosecution witnesses Violeta Constantino and Nenita Camposano, who were bank managers of LandBank's Shaw Boulevard and DepEd Pasig branches, respectively, who described the huge amount of cash withdrawals—by the OVP and by DepEd, when Duterte was its Secretary—as unusual transactions, given that such huge amounts are usually disbursed via checks, not via cash withdrawals.

The defense team of Vice President Sara Duterte sees no need to further question two former Landbank branch managers over their remarks that huge cash withdrawals of two government agencies under her leadership were "unusual."

Speaking to reporters on Wednesday upon the conclusion of the 10th day of Duterte's impeachment trial, defense lawyer Michael Poa said, "It wasn't really on the legal strategy side. It was more of doon naman sa naging testimonya ng witness."

Senate impeachment court Presiding Officer Francis “Chiz” Escudero on Wednesday ruled that the presentation of evidence by the prosecution should be finished first before the camp of Vice President Sara Duterte presents her defense.

Escudero made the decision in response to the suggestion of Senator Bam Aquino IV for the implementation of presenting evidence on the part of both the prosecution and the defense on a per Article of impeachment basis rather than the prosecution finishing all the presentation of their evidence for all four Articles of impeachment first before the defense team is given a chance to rebut it.

Escudero cited that his decision is in line with the precedent of the 2012 impeachment trial of then Chief Justice Renato Corona, the only impeachment trial that reached verdict day, and the condition that the Senate impeachment court will be amenable with Aquino’s suggestion, provided that the both the prosecution and the defense agrees with him.

"We are in receipt of a manifestation from the panel of prosecutors and the response of the respondents, wherein it is clear based on your written manifestations that there is no agreement between the two parties,” Escudero said.

"We shall proceed as originally ruled by the chair [that we finish the presentation of the prosecution’s evidence first]. We shall finish with the presentation of the evidence in chief of the prosecutors for all of the articles of impeachment that they will not withdraw, I'm saying that only because of the Corona impeachment experience we had wherein some Articles [of Impeachment] were withdrawn by the prosecution,” Escudero, who also served as a Senator-judge in the 2012 Corona impeachment trial, said.

Malacañang on Wednesday said that Senators Rodante Marcoleta and Jinggoy Estrada are now under the jurisdiction of the Sandiganbayan amid the former’s call for the Senate impeachment court to find ways to allow them to participate in Vice President Sara Duterte’s impeachment trial.

Palace Press Officer Undersecretary Claire Castro said she believes that that the impeachment court’s ruling, whatever it may be, will not prevail.

“Kung ano man ang magiging desisyon ng Senado patungkol sa manifestation ni Senator Marcoleta, hindi rin po ito mananaig dahil ngayon ang jurisdiction po ni Senator Jinggoy at ni Senator Marcoleta ay nasa kamay po ng Sandiganbayan,” she said in a press briefing.

Nenita Camposano is a retired employee of the Land Bank of the Philippines (LandBank) who previously served as branch manager of the LandBank-DepEd branch.

On Wednesday, July 29, Camposano took her oath as a prosecution witness before the Senate impeachment court in the impeachment trial of Vice President Sara Duterte.

She is among the House prosecution’s witnesses for Article I of the Articles of Impeachment, which alleges the misuse, misappropriation, and irregular disbursement of P612.5 million in confidential funds of the Office of the Vice President (OVP) and the Department of Education (DepEd). The allegations remain subject to proof during the impeachment trial.

Earlier, the Senate impeachment court issued a subpoena directing Camposano to appear and testify, as well as produce documents related to confidential fund transactions, during the July 29 proceedings.

During her testimony, Camposano said the P37.5-million cash withdrawal made by the Department of Education was “unusual,” noting that government agencies typically encash around P10 million in a single transaction.

She also told the impeachment court that it was the first time she had witnessed a government agency withdraw such an amount. —KG, GMA News

A former Land Bank of the Philippines (LandBank) branch manager on Wednesday testified that a former Department of Education (DepEd) official personally encashed three checks totaling P112.5 million in 2023 and left the bank through a fire exit after the transactions.

Testifying at the ongoing impeachment trial of Vice President Sara Duterte, former LandBank DepEd branch manager Nenita Camposano said former DepEd Special Disbursing Officer (SDO) Edward Fajarda encashed three checks worth P37.5 million each at the branch on February 22, April 26, and July 13, 2023.

Prosecution witness Violeta Constantino is a former official of the Land Bank of the Philippines (LandBank) who spent 32 years in the banking industry before her retirement.

In her testimony before the Senate impeachment court, Constantino said she served as department manager of LandBank’s Shaw Boulevard branch in Mandaluyong City, which handled accounts of several government agencies, including the Office of the Vice President (OVP).
