DOLE reminds of pay rules during APEC Summit

How much should a worker get for going to work during the Asia-Pacific Economic Cooperation (APEC) Summit in Metro Manila?

The Department of Labor and Employment is reminding private businesses in the National Capital Region to observe pay rules for holidays and special non-working days during the APEC Economic Leaders' Meeting on November 18 and 19.

Employees reporting for work during the summit should receive an additional 30 percent of their daily rate on the first eight hours plus the cost-of-living allowance.

For instance, workers earning the minimum wage of P466 plus P15 cost-of-living allowance should get P620.80 during the summit (basic daily rate x 130 percent holiday premium + P15 cost-of-living allowance).

Employees should get an additional 30 percent of their hourly rate for work rendered in excess of eight hours.

Every hour of overtime work will mean an additional P98.44 (basic hourly rate x 130 percent holiday premium x 130 percent overtime premium x number of hours worked) for minimum wage earners. 

Should the non-working days fall during rest days, employees should receive an additional 50 percent of their daily rate on the first eight hours and another 30 percent of their hourly rate for overtime work.

The "no-work, no-pay" principle will apply in the absence of a company policy, practice or collective bargaining agreement stating otherwise.

Teaching and non-teaching personnel of private schools will receive no additional pay if they work on November 18 and 19. The "no-work, no-pay" principle will also apply, but accrued leave credits may be used to receive compensation on said days.

President Benigno Aquino III has declared November 18 and 19 as special non-working days in Metro Manila due to the APEC Summit. The private sector also has the option to suspend work on November 16, 17 and 20.

"In view of the proclamation, I enjoin all private sector employers in Metro Manila to observe the proper pay rules for the benefit of their workers," DOLE Secretary Rosalinda Dimapilis-Baldoz said. —JST, GMA News
