DOLE: Private sector workers on duty on New Year entitled to double pay
Private sector workers who will report for work on Wednesday, January 1 or New Year’s Day, are entitled to double their regular daily wage since the day is a regular holiday, the Department of Labor and Employment (DOLE) said.
This benefit is provided under Labor Advisory No. 13, series of 2019, issued by Labor Secretary Silvestre Bello III for employers’ guidance on the proper payment of wages for the regular and special (non-working) days for the year 2020.
Specifically, private sector employees who are on duty on January 1 will be paid 200% of their wages for the first eight hours (basic wage + Cost of Living Allowance or COLA) x 200%). Employees who will not work on this regular holiday will be paid 100% of their wages for that day (basic wage + COLA) x 100%).
Employees who will render overtime work, on the other hand, will be paid an additional 30% of their hourly rate on the said day. This is computed as follows: hourly rate of the basic wage multiplied by 200% multiplied by 130% and multiplied by the number of hours worked.
The DOLE said employees who will work on a regular holiday that also falls on their rest day will be paid an additional 30% of their basic wage of 200%.
Meanwhile, employees who will render overtime work on a regular holiday that also falls on their rest day will be paid an additional 30% of their hourly rate on the said day.
The Labor Advisory No. 13 which provides for double pay is also in accordance with Proclamation No. 845 signed by President Rodrigo Duterte last November 15, 2019. —Llanesca T. Panti/KG, GMA News
