DOLE allows employers to defer holiday pays on April 9, 10, 11


Employers have the option to defer giving holiday pays to their employees for the April 2020 holidays, according to the Department of Labor and Employment (DOLE).

“On account of the existence of a national emergency as aforementioned, employers are allowed to defer payment of holiday pay on April 9, 10, and 11, 2020, as may be applicable, pursuant to Labor Advisory No. 13, Series of 2020 until such time that the present emergency situation has been abated and the normal operations of the establishment is in place,” Labor Secretary Silvestre Bello III said in DOLE Advisory Np. 13-A, Series of 2020 issued April 1.

“Establishments that have totally closed or ceased operations during the enhanced community quarantine period are exempted from the payment of the holiday pay under Labor Advisory No. 13, Series of 2020,” Bello said.

Labor Advisory No. 13 details the payment of wages for regular holidays on April 9 and 10 and special non-working day on April 11.

For April 9, which is a double holiday (Araw ng Kagitingan and Maundy Thursday), an employee who did not work shall be paid 200% of his/her wage for the day, “subject to the requirement that he or she was present or on leave with pay on the workday prior to the start of the enhanced community quarantine on March 17, 2020.”

Those who report to work is entitled for a 300% pay of his/her wage for the first eight hours.

For overtime work during April 9, an employee shall be paid an additional 30% of his/her hourly rate. If the work is done during an employee’s rest day, he/she is entitled for additional 30% of his/her basic wage of 300%.

For overtime work done during an employee’s rest day during the double regular holiday, he/she shall be paid an additional 30% of his/her hourly rate on the said day.

Meanwhile, for work done on April 10 (Good Friday), an employee who did not work shall be paid 100% of his/her salary for the day, “subject to the requirement that he or she was present or on leave with pay on the workday prior to the start of the enhanced community quarantine on March 17, 2020.”

For work done during the day, the employee is entitled for 200% of his/her wag for the holiday, while overtime work shall be paid an additional 30% of his/her hourly rate.

For April 11, the “no work, no pay” principle shall apply unless there is a favorable company policy, practice or collective bargaining agreement granting payment of the special non-working day.

For work done during the special day, he/she shall be paid an additional 30% of his/her basic wage. Overtime work shall be paid an additional 30% of his/her hourly rate on the said day. --Ted Cordero/KBK, GMA News
