The Bureau of Internal Revenue (BIR) on Thursday accused a supplier of the Philippine National Police (PNP) of tax evasion for wrongfully declaring her income.
Remedios Pensotes was charged before the Department of Justice with one count of willful attempt to evade or defeat tax and one count of willful failure to supply correct and accurate information in her 2007 income tax return.
Pensotes was accused of violating Sections 254 and 255 of the National Internal Revenue Code of 1997.
Her company, RJP International Trading Construction and General Services, supplies the PNP with "Maintenance and Other Operating Equipment," according to court records.
She declared sales and service revenues amounting to P10.43 million and P400,000, respectively, in 2007, BIR records showed. Her financial statements reflected total gross income of P3.22 million and a net income of 400,000.
However, voucher and sales invoices submitted by the PNP showed purchases from RJP International amounted to P77.25 million that same year, or P66.42 million short of what the company declared.
"The scheme of Pensotes was to underdeclare her Sales/Revenues in her declaration resulting into a lesser taxable income in her ITR and thus, lower tax liability," the BIR claimed.
It said her total deficiency or income tax liability was P46.33 million, including surcharges and interests.
The case against Pensotes is the 105th filed under the BIR Run After Tax Evaders or RATE program. —Mark Merueñas/VS, GMA News
