Kris Aquino announces Taguig prosecutor backs estafa case vs. Nicko Falcis


 

 

Kris Aquino on Tuesday posted on her social media account that the Taguig City prosecutor has found probable cause to charge her former business associate Nicko Falcis with estafa.

"The truth has finally come out and we are hopeful that all the other cases filed against Nicko Falcis will reach the courts and he will be held accountable for his crimes," read the press statement of Aquino's legal team, which she shared in her Twitter account.

"Ms. Kris Aquino continues to believe in our judicial system. Truth will always be truth, regardless of lack of understanding, black propaganda, or disbelief. Truth will always prevail," it added.

In the same statement, Divina Law said the Taguig City Prosecutor issued a resolution finding probable cause to charge Falcis with estafa through misappropriation of funds, and conversion and violation of Access Devices Regulation Act.

Falcis' lawyer, Regi Ponferrada, said they believe the resolution was "unjust" and that they will file a motion for reconsideration and, "if necessary," a petition for review before the Department of Justice (DOJ).

He said they had "lost faith and confidence in the impartiality" of the Taguig Prosecutor's Office, prompting them last November to move for the case to be referred to the DOJ. Their motion was denied.

Aquino had filed 44 counts of qualified theft against Falcis before city prosecutors in Mandaluyong, San Juan, Taguig, Pasig, Makati, Manila and Quezon City for allegedly spending P1.2 million off of a corporate credit card for his personal expenses.

Falcis has repeatedly denied the allegations.

Earlier, both the Makati and Pasig prosecutors dismissed the complaints against Falcis last month for lack of sufficient evidence.

The Taguig prosecutor also junked the qualified theft complaint, but saw the elements of estafa through misappropriation or conversion as there was "enough evidence to engender a well-founded belief that Falcis converted the corporate credit card extended to him much to the damage and prejudice of Aquino" and her production firm, Kristina C. Aquino Productions (KCAP).

The resolution stated that Falcis used P62,784.32 off of the credit card in restaurants and a hotel in Taguig for "his personal benefit," in "contravention to what was agreed upon when the credit card was first issued. "

"...Although the corporate credit card was issued under the name of Falcis, evidence adduced by both parties established that the same was issued through KCAP and upon the authorization of Aquino herself," the resolution said.

"And, said corporate card was entrusted to him to be utilized solely for the purpose of payment of KCAP-related expenses," it added. —BAP/KG, GMA News
