DOJ recommends raps vs. Enzo Pastor wife, businessman

(Updated 11:42 a.m.) The Department of Justice on Thursday recommended criminal charges against businessman Sandy de Guzman and Dalia Pastor, the wife of slain international racing champ Ferdinand "Enzo" Pastor.
Prosecutor General Claro Arellano, chief of the National Prosecution Service, said the DOJ recommended charges of parricide against Dalia and murder against De Guzman.
Arellano told GMA News Online that the charges would be filed with the Quezon City Regional Trial Court.
In her resolution, Assistant State Prosecutor Susan Villanueva said that while there was no direct evidence pointing to Dalia and De Guzman as direct participants, there was still "interlocking circumstantial evidence that would point to their connivance in the commission of the crime."
Among the circumstances cited by Villanueva was the fact that the Pastors' househelp had earlier claimed knowing the illicit affair of Dalia and De Guzman.
The prosecutor also said it was De Guzman who provided the means for the execution of the plan, while Dalia supplied information on Enzo's exact location.
The prosecutor also found out that the gunman had been instructed to kill Enzo's father, Tomas, as well if he accompanied his son.
"Who could have supplied such vital information, if not respondent Dalia who was with them (Enzo and his parents) at the time (at the house of the racing champ in Makati)," said Villanueva.
Villanueva also took note of Dalia's failure to attend hearings at the DOJ, saying "flight is indicative of guilt."
In August last year, the DOJ filed a murder case against PO2 Edgar Angel, the self-confessed gunman, with the QC RTC.
De Guzman had denied the charges. Dalia was unable to attend the preliminary investigation, but her father did, and insisted on his daughter's innocence.
De Guzman is also facing illegal possession of firearms charges.
The separate frustrated murder charge filed against De Guzman and Dalia for the wounding of Paolo Salazar, Enzo's companion who was hurt in the shooting, was dismissed "without prejudice for insufficiency of evidence."

Angel had initially confessed to the crime but eventually recanted, saying he was forced by the police to confess. The DOJ, however, still filed a case against him.
Separate investigations by the NBI and the Philippine National Police both revealed that a "love triangle" among Pastor, his wife Dalia and De Guzman as the most likely motive for the crime.
Pastor was shot dead by motorcycle-riding men in Quezon City on June 12. At the time, Pastor was driving a truck and stopped at the corner of Visayas Avenue and Congressional Extension Avenue when a gunman approached and shot him.
Pastor was reportedly transporting a race car to Pampanga from Batangas when he stopped at a traffic light at 10 p.m. He succumbed to gunshot wounds in the head, neck and arms. Police recovered shells from a cal-.45 pistol from the crime scene.
Paolo Salazar, Enzo's companion who was hurt in the shooting, claimed Dalia kept on calling her husband and asked him to take the route where they were attacked.
Enzo's mother Remy earlier claimed Dalia had called her, asking her not to tell policemen about the shooting of Enzo.
The parents of Dalia are currently seeking "exclusive custody" over the Pastor chidlren with a Makati Court, which Enzo's parents are opposing. — with Joel Locsin/RSJ, GMA News
