DOLE reminds employers of pay rules for April 9 holiday

The Department of Labor and Employment on Tuesday reminded employers to follow holiday pay rules for employees on Wednesday, Araw ng Kagitingan.
DOLE Secretary Rosalinda Baldoz said these pay rules will also apply to at least three other regular holidays and one special nonworking day in April and May.
Baldoz said the regular holidays in April and May include:
- April 9, Wednesday, Araw ng Kagitingan
- April 17, Maundy Thursday
- April 18, Good Friday
- May 1, Thursday, Labor Day
Under the pay rules for the regular holidays:
- If the employee did not work, he/she shall be paid 100 percent of his/her salary for that day
- If the employee works during the regular holiday, the employee shall be paid 200 percent of his/her regular salary for that day for the first eight hours
- If the employee works more than eight hours (overtime work), he/she shall be paid an additional 30 percent of his/her hourly rate
- If the employee works on his/her rest day, he/she shall be paid an additional 30 percent of his/her daily rate of 200 percent
- If the employee works more than eight hours (overtime work) during a regular holiday that also falls on his/her rest day, he/she shall be paid an additional 30 percent of his/her hourly rate
- If the employee did not work, the “no-work, no-pay” principle shall apply except if there is a favorable company policy, practice, or collective bargaining agreement granting payment on a special day
- An employee who reports for work shall be paid an additional 30 percent of his/her daily rate on the first eight hours of work
- An employee who works more than eight hours (overtime work), shall be paid an additional 30 percent of his/her hourly rate
- If an employee works on a special day that also falls on his/her rest day, payment is an additional 50 percent of daily rate on the first eight hours of work
- If an employee works more than eight hours (overtime work) during a special day that also falls on a rest day, he/she can get an additional 30 percent of the hourly rate
