Mike Arroyo's case vs Tulfos dismissed


A Quezon City judge on Monday formally dismissed the libel case filed by First Gentleman Jose Miguel “Mike" Arroyo against the three controversial Tulfo brothers. The dismissal of the case was contained in a one-page order issued by QC Regional Trial Court Branch 83 Presiding Judge Ralph Lee. The order was based on the affidavit of desistance filed by Arroyo asking the court to drop the case of media personalities Ramon, Erwin and Raffy Tulfo. “Considering the affidavit of desistance to the effect that the complainant (Arroyo) is no longer interested in the further prosecution of the case, as jointly moved by the private prosecutor and the public prosecutor, the instant is dismissed," Lee said. Judge Lee also ordered that the P10,000 cash bond posted by each of the Tulfo brothers be returned. Arroyo filed the affidavit of desistance and motion to withdraw the case last month, a few weeks after he announcing his intention to withdraw all the libel cases that he filed against members of the media. The pronouncement came after Arroyo had survived a triple heart bypass last May. He said that he has already forgiven all those whom he accused of libel. Arroyo had earlier claimed that the Tulfo brothers issued maliciously and libelous statements in a press conference on August 2, 2006 in a QC restaurant where the brothers said that Arroyo had a hand in the cancellation of their program “Isumbong Mo (Tulfo Brothers) aired over government television network RPN Channel 9 and engaged in an illicit relationship with a certain Vicky Toh.- GMANews.TV
