Immigration Bureau orders deportation of Pemberton


(Updated 8:23 p.m.) The Bureau of Immigration (BI) has ordered the deportation of Lance Corporal Joseph Scott Pemberton, the US Marine accused of killing a Filipino transgender in Olongapo City last year, for allegedly being an undesirable alien.

The BI said its order is subject to clearance from Olongapo City Regional Trial Court Branch 74, which is hearing Pemberton's murder case.

The bureau also denied Pemberton's offer of self-deportation for "lack of merit," and included Pemberton's name on its blacklist.

Pemberton, currently detained at a US facility inside Camp Aguinaldo in Quezon City, was charged with murder for the death of transgender Jeffrey "Jennifer" Laude inside an Olongapo lodge in October last year. He has denied the charges, but admitted hurting the victim.



In its order, the BI noted in deportation cases, "even an iota of evidence showing that an alien is unfit to remain in the country is sufficient."

It took into consideration how Laude's friend, Mark Clarence Gelviro aka Barbie, "directly and categorically narrated" during the Senate hearing on the alleged murder "how, when and where" Pemberton "murdered" Laude.

It also noted that Elias Galamos, the cashier in the lodge where Pemberton and Laude checked in after meeting at a bar, had corroborated Gelviro's statement, and that the Office of the City Prosecutor of Olongapo City had found probable cause to charge Pemberton.

"The finding of probable cause and issuance of a warrant of arrest by the Regional Trial Court, Branch 74, of Olongapo City -- is to our mind more than an iota of proof of his (Pemberton) undesirability," the BI said.

"Wherefore, we find respondent Joseph Scott Pemberton, American national, to be an undesirable alien and order his deportation, subject to the issuance of a clearance from the Regional Trial Court, Branch 74, Olongapo City and other appropriate government agencies," the BI ruled.

Meanwhile, the lawyer of Laude's family welcomed the BI order.

"The order of the Bureau of Immigration ordering the deportation of US Marine Lance Cpl. Joseph Scott Pemberton is a welcome development," said Harry Roque Jr. in a statement.

He added, "It was at the insistence of the Laude family that he was made the subject of deportation proceedings. It proves that he is indeed an undesirable alien arising from the killing of Jennifer."

"This notwithstanding, his deportation should be after he serves his sentence, if found guilty. Any contrary ruling will accord him with impunity," Roque said. —KBK, GMA News
