Ex-Comelec chair Brillantes questions COC item on perpetual disqualification


Former Commission on Elections chairman Sixto Brillantes has questioned the item in the Comelec's certificate of candidacy form as regards being found liable for an offense that carries the penalty of disqualification from holding public office.

According to Tina Panganiban-Perez's report on "State of the Nation with Jessica Soho", Brillantes said it would be unconstitutional to force candidates to answer  question on the following:

"Have you been found liable an offense which carries with it the accessory penalt of perpetual disqualification to hold public office which has become final and executory?"

"It is not constitutional if they will force the candidate to answer it and if there is no answer, they will not accept the COC," Brillantes said.

"The completeness or incompleteness of the COC does not depend in answering all di ba?" he added.

According to the Comelec, it would not accept COCs that do not contain answers to any of the questions it posed.

The commission said it had the right to make it easier to determine whether or not a candidate was fit to run for public office. —NB, GMA News
