Duterte, Bato ask SC to reconsider non-issuance of TRO


Former President Rodrigo Duterte and Senator Ronald “Bato” Dela Rosa have asked the Supreme Court (SC) to reconsider its non-issuance of a temporary restraining order (TRO) in connection with their petition seeking to prohibit the government from cooperating with the International Criminal Court (ICC).

“The SC noted without action the Motion for Reconsideration filed by former President Rodrigo Roa Duterte and Senator Ronald Dela Rosa regarding the court’s denial of their prayer for the issuance of a TRO,” SC spokesperson Atty. Camille Ting said in a briefing.

She said the SC ordered the respondents to personally file their comment on the motion within a non-extendible period of 10 days from notice.

Last week, Ting said the SC found that Duterte and Dela Rosa failed to establish a “clear and unmistakable right” for the immediate issuance of a TRO.

In their petition, Duterte and Dela Rosa asked for a TRO to prohibit the government from coordinating and providing assistance to the International Criminal Police Organization (Interpol) or any foreign law agency regarding the execution of warrants.

They also asked for the issuance of a writ of preliminary prohibitory and mandatory injunction for the government to immediately suspend any ongoing cooperation with the ICC.

Duterte is currently under the custody of the ICC following his arrest on March 11.

He appeared before the ICC for the first time last Friday via video conferencing. –NB, GMA Integrated News
