SC denies Duterte Youth’s plea for TRO vs. nullification of registration
The Supreme Court (SC) has denied the Duterte Youth party-list’s request for a temporary restraining order (TRO) to prevent the Commission on Elections (Comelec) from enforcing its ruling that upheld the nullification of the party’s registration.
In a resolution dated September 30, the SC En Banc denied the party’s prayer for TRO, writ of preliminary injunction, and status quo ante order.
It also denied the motion for a special raffle.
GMA News Online has asked the Duterte Youth party-list for comment.
Meanwhile, the SC required the Comelec and other individuals to comment on the petition within a non-extendible period of 10 days from notice.
In August, the poll body junked the motion of reconsideration filed by Duterte Youth that sought to reverse the June 2025 decision of the Comelec Second Division, which voided their registration for being void ab initio, or void from the beginning, due to the failure to comply with the jurisdictional requirements of publication and hearing.
Duterte Youth ranked second during the May 12 elections, garnering 2,338,564 votes and translating to three seats at the House of Representatives.
Meanwhile, the Comelec formally proclaimed Gabriela Women’s Party as the winner of the 64th congressional seat in the elections on September 17. However, it clarified that this is not due to the nullification of Duterte Youth's registration, but to the recomputation of seat allocations.
The three party-lists that have received seats due to the nullification are Abono, Ang Probinsyano, and Murang Kuryente. — BM, GMA Integrated News
