Henry Alcantara appeals PRC decision revoking his license
Former DPWH Bulacan First District Engineer Henry Alcantara has asked the Professional Regulation Commission (PRC) to "reverse, set aside and nullify" its earlier ruling revoking his license as a civil engineer.
The PRC revoked Alcantara's license over gross unprofessional and unethical conduct for his alleged involvement in the flood control controversy.
"…[I]t is respectfully prayed of this Honorable Office to REVERSE, SET ASIDE and NULLIFY" the revocation of Respondent Henry C. Alcantara's professional license as civil engineer for the reasons stated," Alcantara's motion for reconsideration read. The PRC Legal Service received the document on Wednesday, January 14.

Alcantara, through his counsel Atty. Maria Nympha Mandagan, argued that the PRC "committed gross misapprehension of facts" in finding him guilty.
To recall, the Professional Regulatory Board of Civil Engineering (PRB-CE) revoked Alcantara's license after the Department of Public Works and Highways (DPWH) found him—in his former capacity as district engineer officer-in-charge and assistant regional director—administratively liable for grave offenses concerning the disbursement of public funds for non-existent or "ghost" infrastructure projects.
According to Alcantara's motion for reconsideration, the result of the DPWH's investigation on his administrative case is not final as his camp filed a motion for reconsideration with the department.
Alcantara's counsel also said the investigation of the Ombudsman on "administrative incidents" of the former DPWH engineer was "pending for investigation and has yet to be resolved."
"The Respondent moved for reconsideration, respectfully. This Honorable Office committed gross misapprehension of facts in finding GUILTY Respondent Alcantara. The revocation of Respondent Alcantara's professional license is not only premature but highly irregular as well," Alcantara’s motion for reconsideration read.
Alcantara is one of the key figures in the multi-billion peso flood control corruption scandal.
In its decision, the PRB-CE said it gave "primary weight" to the DPWH's special audit report and decision.
"The Board established that Engineer Alcantara willfully approved payments for these ghost projects, an act that constitutes a severe breach of the Code of Ethics for Civil Engineers and a betrayal of public trust," it added.
According to the PRB-CE on Tuesday, the former engineer may file a motion for reconsideration with the board within 15 days. Should the MR be denied, he has the right to file a notice of appeal with the Commission Proper within 15 days from receipt of the resolution.
Alcantara, along with former DPWH Undersecretary Roberto Bernardo and former regional director Gerard Opulencia, are under provisional acceptance to the Department of Justice’s Witness Protection Program (WPP). — VDV, GMA Integrated News
