ICC appeals chamber gives Duterte until Feb. 5, 2026 to appeal ruling on detention

The Appeals Chamber of the International Criminal Court has ordered the defense counsel of former President Rodrigo Duterte to file its appeal by Feb. 5.

This developed after Duterte’s camp filed a notice with the ICC Appeals Chamber seeking the reversal of the Pre-Trial Chamber I’s decision on Duterte’s continued detention.

Duterte is facing crimes against humanity charges before the ICC for murder and attempted murder in connection with the deaths under his war on drugs when he was President and mayor of Davao City.

He is detained at the penitentiary in The Hague.

In a six-page document dated Jan. 28, Duterte’s team requested Duterte’s immediate interim release under the conditions provided by a state party.

“The Defense for Mr Rodrigo Roa Duterte shall file an appeal brief in the above-mentioned appeal not exceeding 20 pages by Thursday, 5 February 2026,” the appeals chamber said in an order dated Jan. 29.

“The Deputy Prosecutor and the Legal Representatives of the Victims may file responses to the appeal brief not exceeding 20 pages by Thursday, 12 February 2026,” it added.

The appeals chamber said that in the present case, it was “appropriate to proceed in this appeal by way of written submissions only.” –NB, GMA Integrated News
