DOJ files tax evasion raps vs. Sarah Discaya at Court of Tax Appeals

The Department of Justice (DOJ) has filed tax evasion charges against contractor Sarah Discaya before the Court of Tax Appeals (CTA), Justice spokesperson Polo Martinez said Friday.

Martinez said the Justice Department filed four counts of tax evasion against Discaya for violations of Sections 254 (Willful Attempt to Evade or Defeat Taxes) and 255 (Willful Failure to Supply Correct and Accurate Information) of the National Internal Revenue Code of 1997.

He said this covers taxable years 2020 to 2021.

“The information for this case was filed in court on February 3 with the CTA which has jurisdiction over the offense,” he said.

Meanwhile, Martinez said contractor Curlee Discaya filed a motion for reconsideration with a deferment to the filing of the information.

“Because of this filing, the BIR as a matter of procedure was asked to comment. And so until such time the BIR can comment and until such time the panel of prosecutors… can resolve on the basis of these documents, then preliminary investigation is continuing,” he said.

For his part, Prosecutor General Richard Fadullon assured that the DOJ will resolve the issue in the coming weeks.

“Rest assured that siguro by the coming week, no, we will have been able to resolve that issue already,” he said.

In September 2025, the Discayas disclosed the names of several congressmen, their staff, and officials of the Department of Public Works and Highways who are allegedly involved in the corruption scheme.

DIscaya is currently committed at the Lapu-Lapu City Jail while Curlee is under the custody of the Senate.

In December 2025, the Office of the Ombudsman charged Sarah and others over a P96.5-million ghost flood control project in the Davao Occidental.

They have pleaded not guilty to graft and malversation charges.—AOL, GMA Integrated News
