Zaldy Co's plunder, Bong Revilla's malversation resos undergoing review — DOJ

Department of Justice spokesperson Polo Martinez on Thursday said the resolutions on the plunder complaint filed against former Ako Bicol Party-List Representative Zaldy Co and the malversation complaint against former Senator Ramon Bong Revilla Jr. are undergoing review.

“The resolutions for Zaldy Co’s plunder case and Revilla’s malversation case are currently under review with the division chief,” Martinez told the media.

Martinez previously said that a resolution under review means the authorities are determining whether the resolution, either dismissing the complaint or recommending to file, is correct.

“The review will cover the handling prosecutors’ discussion of the evidence submitted, the law applied, the legal and factual conclusions derived from the evidence, and ultimately the recommendation for either filing or dismissal,” he said.

According to Martinez, the resolution will then be forwarded to Prosecutor General Richard Fadullon.

“Once signed by the division chief, it will be forwarded to PG for his final review. If PG has any revisions, the draft resolution will be transmitted back to the handling panel of prosecutors,” Martinez said.

Co is facing a complaint for plunder, violation of Section 3(b) of the Anti-Graft and Corrupt Practices Act, and violation of the Code of Conduct and Ethical Standard for Public Officials and Employees.

His co-respondents are former Department of Public Works and Highways (DPWH) Undersecretary Roberto Bernardo and former Bulacan district engineer Henry Alcantara, two of the government’s state witnesses in the flood control controversy.

According to Martinez, Co did not file his counter-affidavit.

“The resolution will be entirely on the evidence submitted by the NBI and the other respondents,” he said.

Co left the country in 2025 for medical reasons and has yet to return. He previously emerged in  Stockholm, Sweden.

He is also facing malversation and graft charges over an allegedly substandard P289-million road dike project in Naujan, Oriental Mindoro.

The Sandiganbayan has declared him a “fugitive from justice.”

Meanwhile, the complaint against Revilla involved a flood control project,  which his camp said was based on “incredible and incompetent” evidence.

The former senator filed his counter-affidavit on January 5 and the complaint was submitted for resolution on January 12. 

Revilla is currently detained at the New Quezon City Jail. — RSJ, GMA Integrated News
