Dating opisyal ng PTV-4, pinakakasuhan ng Office of the Ombudsman

Iniutos ni Ombudsman Conchita Carpio Morales na sampahan ng kaso sa Sandiganbayan ang isang dating opisyal at isang consultant ng People’s Television Network, Inc. (PTNI) kaugnay sa umano'y irregular disbursement ng mahigit P13 milyong sales commissions magmula 2006 hanggang 2008.   Sa 10-pahinang resolusyon ng Ombudsman, inirekomendang kasuhan dahil sa paglabag umano sa anti-graft law sina Jose Isabelo, dating general manager ng PTNI, at si Rolando Luna, PTNI’s Marketing Services Consultant.   Ipinaliwanag sa resolusyon na kinuha ang serbisyo ni Luna bilang “marketing services manager” magmula Enero 1, 2005 hanggang Marso 31, 2011. Sinasabing nakasaad sa kontrata nito na, “this contract does not create an employer-employee contract between [PTNI] and [Luna], xxx and that the latter is not entitled to benefits enjoyed by the regular personnel[.]” Ngunit sakabila nito, nakatanggap umano si Luna ng kabayaran mula sa PTNI na umabot sa P13,829,431.42 bilang sales commissions magmula 2006 hanggang 2008 para sa advertising spots at placements. Ayon sa nagreklamong si Renato Caluag, kasalukuyang general manager ng PTNI, hindi dapat binigyan ng komisyon si Luna dahil wala namang Board Resolution na nagpapahintulot sa nasabing kompensasyon na itinatakda sa Section 15 ng RA 7306 (Charter of the People’s Television Network). Sa isinumiteng counter-affidavit ni Isabelo, ipinaliwanag niya na mayroong Board Resolution No. 2004-014 na nagpahintulot sa PTNI na magbigay ng sales commissions sa kanilang mga tauhan. Gayunpaman, ipinaliwanag sa resolusyon ng Ombudsman na malinaw na nakasaad sa binabanggit na board resolution ni Isabelo na, “the Board Resolution is clear that sales commissions may only be granted to PTNI employees ‘who initiate marketing efforts and generate revenue for the Network’,” at hindi umano kasama rito si Luna na isang "consultant." “From the pieces of evidence available vis-a-vis the feeble justifications proferred by respondents, there is no doubt that Luna was not entitled to the disbursed amount of P13,829,413.42,” deklara sa resolusyon. - RP/FRJ, GMA News
