DOLE reminds employers of pay rules for Holy Week holidays
Before the long holiday break, employers got a reminder from the Department of Labor and Employment to strictly observe the pay rules for their employees who will report for duty during the Holy Week.
In its Labor Advisory No. 5 Series of 2019, the DOLE prescribed the following rules for pay on regular holidays April 18 (Maundy Thursday) and April 19 (Good Friday):
- For work done during the regular holiday, the employee shall be paid 200 percent of his/her wage for that day for the first eight hours [(Basic wage + Cost of living allowance) x 200 percent]
- If the employee did not work, he/she shall be paid 100 percent of his/her salary for that day
- For work done in excess of eight hours (overtime work), he/she shall be paid additional 30 percent of his/her hourly rate on the said day.
- For work done during a regular holiday that also falls on his/her rest day, he/she shall be paid an additional 30 percent of his/her basic wage of 200 percent
- For work done in excess of eight hours (overtime work) during the regular day that also falls on his/her rest day, the employee shall be paid an additional 30 percent of his/her hourly rate on the said day
For those who will work on April 20 (Black Saturday), a special non-working day, the following payment rules shall apply:
- If the employee did not work, the “no work, no pay” principle shall apply, unless there is a favorable company policy, practice, or collective bargaining agreement (CBA) granting payment on a special day
- If the employee worked, he/she shall be paid an additional 30 percent of his/her basic salary on the first eight hours of work
- For work done in excess of eight hours (overtime work), the employee shall be paid an additional 30 percent of his/her hourly rate
- If the special non-working day falls on the employee’s rest day, he/she shall be paid an additional 50 percent of his/her basic wage
- For work done in excess of eight hours (overtime work) during the special day that also falls on his/her rest day, the employee shall be paid an additional 30 percent of his/her hourly rate on said day
