CA denies Bengzon bid to overturn ouster from The Medical City
The appellate court has denied Alfredo Bengzon's motion to nullify the results of The Medical City's board elections that ousted him from the top seat.
In a resolution dated January 21, the Court of Appeals (CA) denied the former Health secretary's motion for reconsideration on a June 2019 ruling which rejected his petition for a preliminary injunction.
The resolution was signed by Associate Justice Ramon Cruz, and Associate Justice Ramon Bato Jr., and Associate Justice Germano Francisco Legaspi.
To recall, Bengzon was ousted during a special stockholders' meeting in September 2018, in which his nephew Jose Xavier "Eckie" Gonzales was elected chairman of the board and Dr. Eugenio Jose Ramos CEO.
The results were questioned by Bengzon, who argued that shares of the members of the board—who entered by investing funds to finance the TMC's expansion—were illegal and invalid.
In its decision, the CA noted that the question of the directors and officers for the term 2018-2019 has become moot and academic, because of the election of new members of the board for the term 2019-2020. — BM, GMA News
