DOLE issues pay rules for work done on Independence Day


Workers who will report for duty on June 12, Independence Day, shall receive 200% or “double pay” of their salaries for the day, the Department of Labor and Employment (DOLE) said Saturday.

In its Labor Advisory No. 12, series of 2021, the DOLE said work done during the regular holiday shall be paid 200% of a worker’s wage for the first eight hours.

For work done in excess of eight hours (overtime) work, the employee shall be paid an additional 30% of hourly rate on the said day.

“However, in view of the existence of a national emergency arising from the Coronavirus Disease 2019 (COVID-19) situation, establishments that have totally closed or ceased operations during the community quarantine period are exempted from the payment of holiday pay on June 12, 2021 under this Advisory,” the DOLE said.

Pay rules

Here are the pay rules issued by DOLE for work rendered on June 12:

  • If the employee did not work, he or she shall be paid 100% of his or her salary for the day [(Basic wage + COLA) x 100%].
  • If June 12 is the worker’s rest day but still reported for work, he or she shall be paid an additional 30% of his or her daily of 200% [(Basic wage + COLA) x 200%] + [30% (Basic wage x 200%)].
  • If the employee worked more than eight hours on his or her rest day on June 12, he or she shall be paid an additional 30% of his or her hourly rate on the said day (Hourly rate of the basic wage x 200% x 130% x number of hours worked).
