DOLE reminds employers of holiday pay rules


The Department of Labor and Employment has reminded employers to observe pay rules for their employees who report for work Tuesday, a holiday marking Eidl Fitr.
 
DOLE Secretary Rosalinda Baldoz cited Labor Advisory No. 06, providing guidelines on the correct wages for private sector workers for work done Tuesday.
 
In a news release, the DOLE said the following pay rules would apply:
 
- If the employee did not work, he or she shall be paid 100 percent of his or her salary for that day.
- If the employee worked, he or she shall be paid 200 percent of his or her regular salary for that day for the first eight hours.
- For work done in excess of eight hours or overtime work, the employee shall get an additional 30 percent of his or her hourly rate on that day.
- If the employee worked and Tuesday is his or her rest day, he or she shall get an additional 30 percent of his or her daily rate of 200 percent.
- For work done in excess of eight hours on the employee's rest day, he or she shall be paid an additional 30 percent of his or her hourly rate on the day.

Meanwhile, Baldoz reminded employers as well to observe the pay rules last Sunday, a special non-working day marking the centennial of the Iglesia Ni Cristo.
 
The pay rules for Sunday include:
 
- If the employee did not work, the “no work, no pay” principle shall apply, unless there is a favorable company policy or collective bargaining agreement granting payment on this special non-working day.
- If the employee worked last Sunday, he or she shall be paid an additional 30 percent of his or her daily rate on the first eight hours of work.
- For work done in excess of eight hours (overtime), the employee shall be paid an additional 30 percent of his or her hourly rate on that day.
- If the employee worked and Sunday was his or her rest day, he or she shall be paid an additional 50 percent of his or her daily rate on the first eight hours of work.
- For work done in excess of eight hours, he or she shall be paid an additional 30 percent of his or her hourly rate on that day. —Joel Locsin/NB, GMA News
