Petitioner appeals junking of disqualification case vs. Alan Peter Cayetano


The petitioner in the now-dismissed disqualification case against former Foreign Affairs secretary and Taguig City first district congressional candidate Alan Peter Cayetano has filed an appeal before the Commission on Elections.

Atty Emil Marañon, lawyer for petitioner Leonides Buac Jr. filed a motion for reconsideration before the Comelec Second Division on Friday.

Buac has questioned why Alan Peter and his wife, Taguig City Mayor Lani Cayetano, have different addresses in their Certificates of Canvass. Lani is a candidate in the congressional race in the city's second district.

The Comelec Second Division has ruled that Alan Peter's domicile remained in his ancestral home, which is the residence he used in his COC while Lani’s domicile was transferred to their conjugal home in Serendra.

"How come there are two different effects for the spouses? That’s abnormal," Marañon told GMA News.

"Nagkamali ang Second Division," he added.

Alan Peter has welcomed the decision of the Comelec Second Division, believing that the disqualification case was connected with their political opponents.

"There's no legal issue because jurisprudence is very clear na iba yung domicile, iba yung residence mo," he said on May 7.

Alan Peter also said there were even earlier instances where spouses have been allowed to represent two separate legislative districts even if they are living under one roof. —KBK, GMA News
