Singer Nina files estafa raps vs Nyoy Volante's parents

MANILA, Philippines - Singer Nina [Marifel Nina Girado in real life] has filed a complaint before the Quezon City Prosecutor's Office against the parents of her former boyfriend for allegedly refusing to pay the P1.1 million they owed her. Named respondent in the complaint were Evangeline and Oliver Volante, parents of singer Nyoy Volante. They were slapped with an estafa complaint, while Mr. Volante was also accused of violating Batas Pambansa Blg. 22 or the Anti-Bouncing Check Law for allegedly issuing bouncing checks as payment to the loan. In her complaint, Nina said that during the preliminary investigation of the case, the respondents offered to enter into a compromise agreement with a promise that they would pay in cash and post-dated checks their P1.4 million loan from her.   In the compromise agreement, which was executed on July 1, 2008, Nina agreed drop the case against the couple. The respondents shelled out P300,000 as initial payment.    Also under the agreement, the Volante couple agreed that the P1.1-million balance shall be paid every 20th of the month starting on August 20, 2008 until February 20, 2010. Nina said she had no problem with the first check worth P50,000 given by the respondents for August 2008. However, the succeeding post-dated checks - from September 2008 to April 2009, with a total of P550,000 - were returned by the bank for being Drawn Against Insufficient Funds (DAIF). “Oliver and Evangeline, conspiring with each other, induced me to believe that they will pay the amount of P1.1-million by issuing post dated checks simultaneous with the execution of the Compromise Agreement where they guaranteed that the checks would be funded and cleared on the dates as they fall due. They induced me to sign the agreement when in fact they do not have an intention to faithfully comply wit the terms and conditions of the agreement," Nina said in her complaint. - GMANews.TV
