Court denies hold departure order petition vs. Kris, Bimby


TV host-actress Kris Aquino and her son Bimby will be able to leave the country after the court denied basketball star James Yap's request to issue a hold departure order (HDO) against them.
 
The Makati Regional Trial Court branch 144 made the ruling on Friday when it heard the petition filed by Yap against his ex-wife Kris and his son Bimby, who are scheduled to leave for a holiday in France on Saturday.
A source familiar with the case confirmed the ruling but declined to give further details, citing the gag order that the court has issued to both camps on the domestic squabble.
Aquino had filed a temporary protection order against Yap after he allegedly tried to “overstep his boundaries and of attempting to seduce her while visiting her home, and of inflicting psychological harm on their son Bimby."
 
She also accused the professional basketball player of hurting her in December last year "as if he was still entitled to his matrimonial rights." Yap has denied her accusations, and said Aquino was preventing him from seeing his son.
 
On Thursday, Aquino said she has decided to resign from all her shows and leave the country. Yap's legal counsel, Lorna Kapunan, said Aquino's pronouncement made their HDO request an urgent matter.
Kapunan said the request for an HDO was not meant to prevent the TV host and her son from traveling abroad, but simply for Yap to be notified where and when they would take foreign trips. Aquino's lawyer Frank Chavez, however, said an HDO would violate his client's right to travel. He added that such an order is issued only on matters of national concern. Kris Aquino is the youngest sister of President Benigno Aquino III. Yap has said that Kris dropped PNoy's name during one of their arguments, but Kris dodged the question in an interview with GMA News on Thursday. - YA, GMA News
