DOJ shelves complaint vs Daboy


The Justice department absolved actor Rudy Fernandez from the complaint filed by a former colleague whom he allegedly pistol-whipped in 2005, radio station dzBB reported Tuesday. According to the report, the DOJ found no probable cause for the filing of grave threats, slight physical injuries and oral defamation charges against Fernandez and a certain Joey Padilla. The charges stemmed from the complaint filed by Robert James Stewart, also known as Robby Tarroza, who accused Fernandez of pistol-whipping, beating and hurling invectives at him. The DOJ said the complainant failed to prove his allegations saying Fernandez could not have used his gun against Stewart because the former would have been forced to surrender this to the building’s security officers. It added Fernandez's utterances were ordinary expressions of anger and hatred. Stewart said that on Oct. 25, 2005, Fernandez and Padilla arrived at the office of Viva Entertainment at Tektite Towers in Pasig City and without warning, pistol-whipped and shouted at him. Padilla allegedly beat him. The complainant said Fernandez accused him of being the cause of their deportation from Japan on October 21. The actor was scheduled to perform there in a series of shows with his former wife, actress Alma Moreno. They were with Moreno’s former boyfriend, Gerald Martin Madrid; her two children, and three other production assistants. Stewart allegedly sent a letter to Japanese embassy to prevent another Viva talent from entering and performing in the said country.
