Sandro Muhlach to appeal dismissal of acts of lasciviousness charge vs. contractors

Sandro Muhlach said his camp will appeal the Pasay Metropolitan Trial Court's decision to dismiss one of the charges filed against independent contractors Jojo Nones and Richard Cruz concerning his alleged sexual assault.

According to a "State of the Nation" report on Wednesday, the Pasay METC Branch 46 granted Nones and Cruz's motion to quash the two counts of acts of lasciviousness filed against them.

The court said the filing of acts of lasciviousness case was an "overkill" because it can be considered an element of rape through sexual assault, which the Department of Justice filed with the Pasay Regional Trial Court.

"Fast Talk with Boy Abunda" Thursday aired Mulach's Instagram Stories post where he clarified that the Pasay METC only dismissed the acts of lasciviousness charge.

"The court removed the acts of lasciviousness charge because it's already part of the sexual assault case, which is still ongoing. Meaning, mas matindi ang magiging kaso," said Muhlach.

He added that his camp will file a motion for reconsideration before the Pasay METC.

"But we will still file for reconsideration for acts of lasciviousness. Hindi sila makakalusot dito at ilalaban ko 'to hanggang sa huli! I will make sure na hindi na kayo makakaulit sa iba! #ENDRAPE," he said. 

Meanwhile, Atty. Maggie Abraham-Garduque, the legal counsel of Nones and Cruz, said in a statement that aired on "Fast Talk with Boy Abunda" that they were happy with the court's decision.

"We already received the resolution on that and we are very happy that the court saw the legal infirmity that we have been raising since the onset of the case," she said.
